Many employees are scared of filing a workers’ compensation claim for fear of their employer retaliating. The reality is that workers’ compensation is every employee’s right, and it is provided to you by the laws of the State of Illinois. Retaliating against an employee for doing so is illegal.

Firing someone is just one form of retaliation. But it isn’t the only form of employer retaliation.  If an employee is harassed or discriminated against at work after a claim, or even directly because of it, this is also considered retaliation. For example, the denial of an expected promotion for no apparent reason, a demotion, a performance review was lower than deserved, or an employee is given a reassignment, reclassification, or transfer that was unnecessary, these can all be retaliatory responses.
